These Terms and Conditions (“Terms”) govern your use of the website www.nu-trend.co.uk and the purchase of bespoke sofas and upholstered furniture from Nu-Trend Interiors. By accessing or using this website, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, you must not use this site.
1. Acceptance of Terms
By using our website or placing an order with Nu-Trend Interiors, you confirm that you have read, understood, and agree to these Terms. We reserve the right to amend these Terms at any time without notice, and it is your responsibility to review these Terms periodically.
2. Bespoke Orders & Customisation
All of our sofas and upholstered furniture are made to order and tailored to your specifications. Each piece is crafted specifically for you, based on your chosen fabric, leather, size, and style preferences. As such, we are unable to accept returns for products that do not meet your expectations in terms of appearance, style, or material, unless the product is faulty.
3. Returns, Cancellations, and Faulty Products
• No Returns for Personal Preferences: Due to the bespoke nature of our products, we do not accept returns if you change your mind about the colour, material, or style of your sofa or upholstered furniture. It is highly recommended that you order a fabric or leather sample before confirming your order, as colours may appear differently on-screen compared to the actual material.
• Faulty Products: If your sofa or upholstered furniture is defective, we will repair or replace the item in accordance with our 15-Year Construction Warranty. This warranty covers defects in materials or workmanship but does not include damage caused by wear and tear or misuse, such as damage to cushions or fabric/leather over time.
• Order Cancellation: Orders can be cancelled only before your materials are ordered and the manufacturing process begins. Once production has started, cancellations are not accepted.
4. Measurements and Access
It is essential that you ensure the measurements of your furniture are correct and that the furniture will fit in your desired space. We cannot be held responsible for any items that do not fit into your home due to inaccurate measurements or restrictions such as narrow hallways, small doors, stairs, or inaccessible entry points. We recommend measuring your space and ensuring that your entryways, hallways, and any areas through which your furniture must pass are clear and wide enough to accommodate the piece. If you live in an apartment complex or a building with narrow corridors, please confirm that the item can be delivered without obstruction.
5. Fabric and Leather Samples
• Sample Ordering: We strongly encourage you to order a fabric or leather sample before placing an order, as colours and textures may vary depending on lighting and screen settings. Once you’ve received your sample, you can make your decision with confidence before finalising your bespoke order.
6. Payment and Pricing
• Pricing: All prices are listed in GBP, excluding taxes and delivery charges, unless stated otherwise. We reserve the right to change prices at any time. Any price changes will be communicated to you before your order is processed.
• Payment: Full payment is required at the time of order. Payments can be made via credit/debit card, bank transfer, or other available payment methods on the website. Your order will not be processed until payment has been successfully received.
7. Delivery and Shipping
• Delivery Times: As our products are bespoke, delivery times may vary. We will provide you with an estimated delivery date when your order is confirmed, but please note that this is an estimate and is subject to change based on production schedules.
• Shipping Costs: Shipping costs will be calculated at checkout based on your location and the size of the items. Delivery fees are non-refundable once the product has been dispatched.
• Damaged Goods on Arrival: If your sofa or furniture arrives damaged, please notify us immediately upon delivery (within 48 hours). We will arrange for repairs or replacements if necessary, in accordance with our warranty terms. This is highly unlikely, however, as all bespoke furniture will be set up, and thoroughly checked before it is left with the customer to make sure everything is okay, and that there have been no damages caused during delivery.
8. 15-Year Construction Warranty
We offer a 15-year construction warranty on all our bespoke sofas and upholstered furniture, which covers any defects in workmanship. This warranty does not cover damage caused by normal wear and tear, including but not limited to:
• Cushion softening or compression over time
• Staining or damage to fabric/leather caused by misuse, spills, or accidents, wear from pets or improper cleaning. If you believe your product has a construction defect, please contact us immediately. We will arrange for an inspection and, if covered under warranty, repair or replace the faulty item.
9. Intellectual Property
All content on this website of our bespoke furniture or Nu-Trend brand, including but not limited to text, images, graphics, logos, videos, and software, are the property of Nu-Trend Interiors or our licensors and are protected by copyright and intellectual property laws. You may not copy, distribute, or use any of this content without our explicit written consent.
10. Limitation of Liability
To the fullest extent permitted by law, Nu-Trend Interiors shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or products purchased from us. Our liability is limited to the amount paid for the defective product.
11. Indemnification
You agree to indemnify, defend, and hold harmless Nu-Trend Interiors, its affiliates, directors, employees, and agents from and against any claims, losses, liabilities, damages, and expenses (including legal fees) arising out of your use of the website or breach of these Terms.
12. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
